Who are we?

Skuldhulp provides debt counselling services to consumers ("Skuldhulp" or "we"). Skuldhulp operates in South Africa, and depending on the circumstances, we may be either a "Responsible Party" or an "Operator" in terms of the Protection of Personal Information Act, 4 of 2013 (POPIA) with regards to your personal information, and we want to take certain steps to ensure that you are fully aware of exactly who we are, the type of personal information we process, how we process it, with whom we may need to share it, as well as your rights with regards to our processing of your personal information under POPIA.

We process personal information from our clients, employees, service providers, suppliers, and various other stakeholders that enable us to operate ("Business Contacts") in order to conduct business with them or provide our services as required. In this notice, "you" refers to you as an individual with whom we deal and whose personal information/data we may need to collect and process to provide the requested services, or the entity you represent. We may need to collect and process your personal information/data for the purposes described below.

What personal information/data is collected?

Skuldhulp collects and processes a wide range of personal information/data as part of conducting our business and fulfilling our obligations to our clients and other data subjects. We would like to inform you that when you interact with Skuldhulp, whether to request a quotation, inquire about our services or product offerings, or enable Skuldhulp to fulfill its obligations to you in terms of your contractual relationship with Skuldhulp ("Skuldhulp Engagement"), you may need to provide certain personal information/data, including but not limited to:

  • Surnames;

  • Entity names;

  • Information regarding the entity you represent;

  • Telephone numbers;

  • Email addresses.

 

The aforementioned personal information/data does not necessarily encompass all types of personal information/data we may require from you under your Skuldhulp Engagement, and the type of personal information/data we may need to process will depend on the exact nature of your Skuldhulp Engagement. The purposes for which Skuldhulp will process any of your personal information/data will also depend on the circumstances that necessitate or require such processing in terms of the relevant Skuldhulp Engagement.

We collect and record all phone calls, internet communication, and all correspondence we have with you, regardless of the communication medium, details of your interactions with us, including your visits to our website and mobile application, although not all of this information will necessarily be personal information. In some cases, we process certain information solely to improve your use of our website and application interfaces.

What do we do with your personal information and why do we collect it?

We take your privacy very seriously, and we collect and process personal information (and where applicable, special personal information) only for specific purposes related to our legitimate business purposes, and information we generally need to fulfill our obligations to you and comply with the legal obligations imposed on us by applicable laws.

The personal information you provide to Skuldhulp is typically processed for the following purposes:

 

To contact you

When we contact you, your personal information enters Skuldhulp’s environment, where it is made available to our trained consultants. Our consultants have received appropriate privacy training and will ensure that your information is securely entered into our system, where it can be protected from a technical information security perspective. Those who have access to your information will then only contact you to determine your needs and how we can assist you. When you directly ask us to contact you, we will do so as soon as possible.

It may happen that we obtained your information from someone other than yourself (perhaps you consented to a marketing campaign, or one of your family or friends selected you to be contacted through Skuldhulp’s referral program). Regardless of where we obtained your information from, and in accordance with our Privacy Policy (“Privacy Policy”), if you do not want Skuldhulp to contact you, we want to respect that. Therefore, when we contact you after obtaining your contact information from someone other than yourself, we will tell you where it came from and also ask if you would like to proceed with the engagement.

To give you a quotation

​

If you have requested a quotation, whether through our website or any other interface, you know who we are and what we do. To provide you with a quotation, we will need certain personal information from you, and our consultants will tell you exactly what information we require, why we need it, and where we might obtain it from if you do not have it at hand. This information is essential for us to customise your quotation. Again, we will always be honest with you, so if you have any concerns about providing the requested information, please let us know so we can explain why it’s important and ensure you’re comfortable before proceeding.

 

Throughout this process, when we collect your information, it moves from you, passes through the trained hands of our employees who are required to handle it and input it into our system, where it will become part of your own unique profile. This profile is unique to you, and once it is created, your personal information resides within Skuldhulp’s system infrastructure.

 

To deliver our products and services

Once you have accepted our quotation, and your profile resides in Skuldhulp’s system, it can only be accessed by authorised employees and/or service providers, who have access to it solely for the purpose of fulfilling our contract with you and ensuring you are satisfied with our service. To deliver our products and services to you and always ensure you are satisfied, we may need to share your personal information with certain third parties (your selected contacts, employees, brokers, service providers, suppliers, and business partners). When we do so, we do so under specific agreements or mandates that ensure these selected third parties comply with POPIA. If we need to ask for your consent to share your personal information with anyone else and, for some reason, our Privacy Policy, this privacy notice, or our contract with each other does not provide for such sharing, we will always take reasonable steps to obtain your consent.

 • One of our trained sales consultants will contact you to discuss what we can offer you and will always ask if you wish to proceed. If you do not want to be contacted, tell us, so we can ensure it does not happen again. We might try to convince you otherwise and ask you to read this notice, but that’s only because we care and want to ensure you make an informed decision.

  • We do make use of various social media platforms to market our products and services. We do not have the ability to specifically target you through these platforms, but if you see one of our ads and want to know more about who we are and what we have to offer, feel free to click on the ad or fill out the form. You will either be referred to our website (https://skuldhulp.co.za/) or to a digital lead form that will enable you to get in touch with Skuldhulp. We will ask you to agree to certain terms and conditions and acknowledge that you have read this privacy notice. We will not hide anything in the fine print; we just want your consent to contact you and tell you what we have to offer.

 • Sometimes, it may be easier for you to read an email than to take a call. We may send you an email from time to time, but we don’t want you to feel like we are spamming you, so if you’re interested in what we have to offer, please opt-in for further email communication.

Each time we contact you, regardless of how we do so, we will always ask if you would like to opt out. We will always respect your decision and just ask that you consider it carefully before proceeding.

 

To comply with applicable laws

We are subject to many important laws and regulatory requirements. We take our compliance obligations seriously, and as such, we are legally required to collect and process certain personal information for very specific purposes.

We also reserve the right to disclose your personal information in the interest of enforcing any terms and conditions of our commercial agreement with you. This notice applies to all data (including all personal information/data) in the past, present, or future submitted by you to Skuldhulp or that we have otherwise obtained in the course of our normal business activities.

 

How is your personal information/data collected?

We may use both "active processing" and "passive processing" methods to collect and process personal information/data. When Skuldhulp uses "Active Processing" means to collect your personal information, it is directly provided by you following an inquiry regarding our products or services, or when you provide personal information/data to Skuldhulp pursuant to a specific Skuldhulp Engagement.

In cases where Skuldhulp uses "Passive Processing" means, it means that Skuldhulp has not been actively provided with your personal information/data, such as when Skuldhulp deploys passive processing means and certain technologies to collect information from you, such as by using cookies, web beacons, embedded scripts, and/or device identifiers, which are deployed and obtained from the website Skuldhulp uses, accessed at https://skuldhulp.co.za/. These passive processing methods allow Skuldhulp to process certain types of non-personally identifiable information that may not be directly linked to you. How to manage cookies?

With whom do we share your personal information/data?

Skuldhulp primarily holds information and data in South Africa. However, from time to time, we may transfer personal information/data to data centres in other countries, but only for the lawful purposes described above and always subject to Skuldhulp’s privacy policy. It may be necessary to share your personal information/data with selected business contacts on a need-to-know basis. We assure you that we consistently apply our Privacy Policy to our business contacts and establish a legal justification, which may include consent, for sharing Personal Information/Data with any third party. We will enter into written agreements with them to ensure that your personal information/data remains secure, confidential, and used only for the agreed-upon purpose.

To assess and determine the profile of our clients and/or projects, we may share your personal information/data with our preferred verification agencies. The list of current agencies used is available upon request from the Information Officer. Please note that we do use service providers to assist us in delivering our services or products to you. We also use service providers to manage and maintain this website, and as such, any personal information/data you provide when using the website or inquiring about the products and services offered is shared with our service provider that maintains the Website. Where do we store your personal information/data?

​

Skuldhulp has implemented reasonable technical and organisational information security measures to protect personal information/data. All your personal information is securely stored by Skuldhulp through the use of a combination of cloud-based and on-site storage facilities. Consequently, in storing your personal information/data, we may transfer personal information/data outside of South Africa to a foreign country or transfer it, meaning personal information may be stored on servers located outside South Africa in foreign countries that have different data protection laws in place. Skuldhulp is satisfied that these foreign countries protect personal information/data to a degree comparable to the way we do, which is acceptable to us.

Despite all our efforts to keep your personal information safe and secure, unauthorised access remains a possibility. Skuldhulp will not take responsibility for anyone outside Skuldhulp’s control who breaches its security measures. You should check the terms of use and security of any third-party websites made available through hyperlinks on any of our websites, mobile applications, or websites before using them.

How long do we store your personal information/data?

Skuldhulp will store or retain your personal information/data for the period required in accordance with Skuldhulp’s legitimate interest in doing so or for the period necessary to comply with our legal and regulatory obligations concerning the storage of specific types of records and/or information.

You have rights when it comes to your personal information/data, but keep in mind that there may be various considerations when deciding how to handle any requests you may have.  • Right of access – You can ask us for a copy of the personal information/data we hold.   

 • Right to know – You can ask us which personal information/data has been shared with any of our business contacts or any third party.   

 • Right to amend – You can ask us to update your personal information/data or delete any personal information no longer accurate or relevant.   

 • Right to object – You can object to our processing of your personal information/data.  

  • Right to file a complaint – You can file a complaint with the relevant authorities if you feel aggrieved by how we have processed your personal information/data.

As you now know, we take keeping your information safe seriously and only process it for purposes you are aware of and that are legally tied to our business operations. As such, we implement reasonable security measures and protocols to protect the personal information/data we are privileged to safeguard. These measures are in place to protect any personal information we hold from unauthorised disclosure, loss, damage, destruction, or unauthorised access. As you will appreciate, nothing is 100% secure in this day and age, so we ask that if you suspect that either you or we have had an information security breach, please notify us immediately so we can take action.
